6. Delivery of goods

 6.1 The Buyer undertakes to indicate the exact place of delivery of the goods.

 6.2 The fee for the delivery service is specified in the e-mail. on the store page and valid at the time of placing the order for the goods.

6.3 The buyer undertakes to accept the goods himself. In the event that the Buyer is unable to accept the goods himself and the goods are delivered to the specified address, the Buyer shall not have the right to make claims to the Seller regarding the delivery of the goods to the wrong entity.

6.4 Goods are delivered by Lithuanian Post or DPD

6.5 The Seller delivers the goods to the Buyer in accordance with the terms specified below.
6.5.1 Deadlines for sending goods:
* after ordering the goods and making the payment before 14:00, the goods will be sent within 1-2 days.
* after ordering the goods and making the payment after 14:00, the goods will be sent within 2-3 days
* after ordering the goods and making the payment on a non-working day, the goods will be sent within 2-3 days

6.5.2 LOCAL DELIVERY - Lithuania

6.5.2.1. Delivery of DPD LOCKER or THE SPECIFIC ADDRESS WITH COURIER

* DELIVERY OF THE ORDER AT THE SPECIFIC ADDRESS WITH COURIER usually within 2-5 days after goods are send, under the conditions specified by the courier. Delivery fee 5.99 Eur. Make sure the contacts are listed correctly, otherwise the delivery time may be longer. Shipments are not delivered on weekends.

6.5.2.2 WITHDRAWAL OF GOODS at the collection point at Palangos str. 16, Kaunas (SKARELE store, entry from Kurpių str.), goods are delivered FREE OF CHARGE

6.5.3 WORLDWIDE DELIVERY
6.5.3.1 SHIPPING WORLDWIDE. We are shipping worldwide using LT post services and sending directly to address provided by the buyer. Delivery fee is from 10.50 Eur (according to buyers adress). Make sure the contacts are listed correctly, otherwise the delivery time may be longer. 


6.6 In the event of unforeseen circumstances, www.skarele.com reserves the right to extend the delivery time by informing the customer by e-mail. If the buyer refuses to wait, he has the right to terminate the contract and recover the money paid as soon as possible.

6.7 Delivery times may vary during holiday periods or other unforeseen circumstances.

6.8 In all cases, the Seller shall be released from liability for violation of the terms of delivery of the goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Seller's control.

6.9 In all cases, the Buyer who notices any damage to the packaging during delivery must comment on the delivery document submitted by post or courier or draw up a separate report on such damage. The Buyer must do this in the presence of a courier or collect the goods at the post office. If the Buyer fails to inspect the packaging, the delivered goods, their quantity and / or the consignment delivery document submitted by the courier / post office, these consignments are considered to be fit and undamaged.

6.10 In all cases, the Buyer must immediately inform the Seller if the consignment is presented in a damaged package, if the consignment contains unordered goods or their incorrect quantity, incomplete goods.

7. Return of goods

7.1 Defects in goods shall be remedied, goods shall be replaced or returned in accordance with the Retail Trade Rules and the provisions of the Civil Code of the Republic of Lithuania. In accordance with the provisions of paragraph 25 of the Retail Trade Rules, goods sold to consumers under consumer purchase and sale contracts concluded remotely or outside of commercial premises shall be returned in accordance with the procedure established in Articles 6. 228 and 6.228 of the Civil Code of the Republic of Lithuania within 14 working days from the date of receipt of the shipment.

7.2 For exchange and return of goods it is necessary to contact in advance by e-mail. by mail.

7.3 Exchange and return of goods is possible only if:

7.3.1 The returned item  did not meet the consumer's expectations or is of inadequate quality.

7.3.2 The returned item was not worn

7.3.2.1 there is no defect in the returned goods

7.3.2.2 the returned goods have not lost their appearance

7.4 All gifts received with the returned item must be returned with the returned item

7.5 If the goods are not fully assembled, damaged, untidy, the Seller has the right not to accept the goods, not to change them and not to return the buyer's money paid for the goods.

7.6.1 When the returned goods do not meet the consumer's expectations, the goods are returned at the Buyer's expense, i.e., the shipping costs are paid by the buyer.

7.6.2 When returning goods of inadequate quality, the Buyer shall be refunded the full amount paid, including the costs of the initial delivery of the goods and their return to the Seller. If, when the Buyer returns a product of inadequate quality, the Seller has not ensured the organization of the return process and the payment of costs, the Seller shall reimburse the Buyer for the costs incurred, upon presentation of supporting evidence by the Buyer.

7.7.1 If the Buyer terminates the purchase and sale agreement because the goods did not meet the Buyer's expectations, the Seller shall, within fourteen days of receiving the consumer's notice of withdrawal from the contract, refund the Buyer all sums paid, including the delivery costs paid by the consumer.

7.7.2 If the Buyer terminates the purchase and sale agreement due to the poor quality of the goods, the Seller, upon receiving the returned goods or evidence provided by the Buyer that the goods have been sent, shall refund the price paid for the goods to the Buyer within fourteen days.

7.8 The Buyer has the right, without giving any reason and without incurring any costs other than those specified in Article 6.228 of the Civil Code of the Republic of Lithuania, within fourteen days, to withdraw from a distance contract or a contract concluded outside business premises, except for the exceptions provided for in paragraph 2 of this article.

7.9 The Buyer's request to replace or return goods of satisfactory quality shall only be satisfied if the goods have not been used, are undamaged, have retained their consumer properties, and have not lost their commercial appearance (Civil Code, Article 6.362(3)).

7.10 If the returned goods are damaged, their consumer properties or marketable appearance are impaired due to the buyer's fault (i.e., damaged by the buyer), the Seller has the right to refuse to accept such goods and not to refund the price paid for them (based on the requirement of Article 6.362 of the Civil Code that the returned goods must be unused and undamaged).

8. Liability

8.1 The Buyer is fully responsible for the accuracy of the personal data provided by the Buyer. If the Buyer does not provide accurate personal data in the registration form, the Seller is not responsible for the consequences.

8.4. 8.4.1 An event beyond the control of the Seller means any act or event beyond the reasonable control of the Seller.

8.5 The Seller is not responsible for the information provided on the websites of other companies, even if the Buyer accesses these websites via links in the Seller's online store.

9. Product warranty

9.1 The statutory warranty is valid for two years from the date of purchase. The buyer has the right to contact the seller within two years from the date of delivery of the item if the goods do not meet the quality requirements set forth in the Civil Code of the Republic of Lithuania.

9.2 In addition to the statutory warranty, goods are also covered by a commercial warranty valid for one year from the date of purchase, covering the quality of the product in the event of fabric damage, color fading, or thread breakage that is not the fault of the customer. The buyer has the right to contact the seller within one year from the date of delivery of the item if the goods are of inadequate quality.

9.2.1 During the commercial warranty period, the Seller offers warranty repairs, if possible, or replacement with a new product.

9.3 The warranty does not apply and the seller is exempt from liability:

9.3.1 If the defects in the goods arose due to improper maintenance or use, including cases where the maintenance instructions provided were not followed.

9.3.2 If the defects arose due to mechanical damage (cuts, scratches, impact damage, etc.).
9.3.3 In the event of natural wear and tear of the goods, which occurs over a longer period of use.
9.4 Procedure for reporting defects:
9.4.1 The Buyer must submit a written claim with a detailed description of the defect and photographs by email to skarele@skarele.com within the specified warranty period and attach documents proving the purchase of the goods.

9.4.2 If a warranty case is established, the Buyer may, in accordance with the law, request the Seller to

9.4.2.1 repair the goods,

9.4.2.2 replace the goods with goods of good quality,

9.4.2.3 reduce the price,

9.4.2.4 a refund if the defect in the goods is significant and cannot be repaired or replaced

9.5 Investigation of defects and dispute resolution

9.5.1 In the event of a dispute, the Seller reserves the right to conduct an expert examination of the defect. If it is determined that the defect was caused by the Buyer, the Buyer shall pay for the defect examination.
